The Company collects, uses, processes, discloses and retains your personal information and data when you access or use the Company’s website or services. This Privacy Policy (“Policy”) discloses the privacy practices for SHISAKO (the “Website”) ofSHISAKO DESIGN INC. (“Company”, “we or “us”), as well as related products and services the Company may offer to you (collectively referred to as the “Services”). This Policy also explains how personal data and other information that the Company receives or collects about you may be used.  The term “you” or “User” refers to any individual that accesses or uses the Website, or uses or purchases any of the Company’s Services.

This Policy is designed to be read in connection with our Terms of Use, which is available at[live link to Terms of Use]. In this Policy, the Company explains our privacy practices and how the Company collects information, including your rights as Users. 

BY ACCESSING THE COMPANY’S WEBSITE AND USING ITS SERVICES, YOU AGREE TO BE BOUND BY BOTH THE WEBSITE’S TERMS OF USE, AS WELL AS THIS POLICY.

DATA COLLECTED

In order to better provide you with the Website and Services, the Company may collect two types of information about Users: personal data that lets us know the specifics of who you or as otherwise defined under applicable law (“Personal Data”), and aggregate information, which does not by itself identify you, but is a collection of information related to a collective of Users (“Aggregate Information”). Note that while you determine whether to disclose Personal Data to us, if you elect not to do so, we may not be able to provide you with the full User experience.

The data we may collect includes: 

1. Personal Data: voluntarily provided information which may include your name, address, date of birth, phone number, email address, login name and password, payment or banking information, location data, device and network information such as IP address, browser type, unique device identifiers, advertising identifiers, other information that you provide us through your user account; or

1. Aggregate Information: non-personal anonymous demographic information, transaction related information relating to the types of products or services requested or provided, order details, delivery information, amounts charged, payment methods, customization services, information about returns or exchanges, communication information when you communicate with us or other information automatically collected when visiting our Website or using our Services, which may include cookies, third party tracking technologies and server logs.

COOKIES

Cookies are electronic data which contain information about you. They are stored on your computer or other devices when you access websites and are widely used to remember you and your preferences.

The Company and third party service providers use cookies or other tracking tools to better provide you with Services, in addition to any other purposes described in this Policy or any other policy we may publish on the Website from time to time.

COLLECTION METHOD AND PURPOSE

The Company uses Personal Data you provide to us, for example by way of surveys and/or other online forms you complete, emails you send us, or signups for newsletters, giveaways or contests for various purposes. The Company may use the Personal Data to create or modify your user account, complete transactions you request, provide you with subscriptions or promotional information to you, deliver advertising and content targeted to your interest on our Services, provide and/or improve our Services, send notifications to you, communicate with you, conduct research and testing related to the Services, participate in corporate transactions including but not limited to mergers, acquisitions, reorganization or amalgamations, perform our obligations under this Agreement, share your Personal Data with unaffiliated companies or individuals that perform services on our behalf such as customer support or payment processors, with our professional advisors in connection with corporate transactions, with third parties that we have your consent to share such information with, comply with legal or regulatory obligations and other reasonable purposes as permitted by law.

The Company and/or associated third party service providers may collect Aggregate Information, such as the collection of your IP address to diagnose system errors or to administer our Services.

DATA TRANSFERS AND RETENTION

The Personal Data the Company collects may be transferred to and stored or otherwise processed in Canada and/or in the United States.  The Company may transfer Personal Data to service providers that process personal data in Canada and/or in the United States.

The Company retains Personal Data in accordance with applicable Canadian law. The Company will not retain Personal Data longer if such data is no longer needed for the purpose that it was collected.

For example:

1. Personal Data collected for purposes related to the performance of a contract between you and the Company shall be retained until such contract has been fully performed; and

1. Personal Data collected for the purposes of the Company’s legitimate interests shall be retained as long as needed to fulfil such purposes. You may find specific information regarding the legitimate interests pursued by the Company within the relevant sections of this document or by contacting the Company.

The Company may retain Personal Data for a longer period if: 

1. you provide such consent to the Company; or

1. the Company is required to do so for the performance of a legal obligation.

The Company will delete your Personal Data when it is no longer required for its intended purpose or when the Company is not legally obligated to retain such data. Your right to access, request erasure, request rectification and data portability cannot be enforced once the Company deletes such data.

AGE OF MAJORITY 

The Company does not provide Services to individuals under the age of 18. You represent that you are the age of majority in the jurisdiction of your residence. 

DISCLOSURE OF INFORMATION

The Company will not use or disclose your Personal Data except in accordance with this Policy or under the following circumstances:

1. as necessary to provide Services you;

as otherwise described in this Policy or to which you have consented;

1. as required by law;

1. to auditors which agree to keep the data confidential;

1. as necessary to enforce the Terms of Use, other policies and regulations in accordance with this Website and Services; and 

1. as necessary to maintain, safeguard and preserve all the rights and property of the Company.

SUBSCRIPTIONS

Users may discontinue receiving any emails or newsletter communications from the Company by unsubscribing or opting out of any such communication. 

THIRD PARTY APPLICATIONS OR WEBSITES

The Website may include links to other applications or websites that are controlled by third parties. The Company does not monitor or control any such third party provider, and we are not responsible for any of the content, user terms, or privacy policies for such applications and/or websites. YOU ARE STRONGLY ADVISED TO READ THE TERMS AND POLICIES OF ALL APPLICATIONS AND WEBSITES PRIOR TO VISITING SAME.

NON-CANADIAN USERS

Privacy of Children:The Website and Services are intended for people who are at least 18 years of age. The Company adheres to the Children’s Online Privacy Protection Act (COPPA) and will not knowingly collect Personal Information from any child under the age of 13. The Company asks that minors (under the age of 18) not use the Website or Services. If a child under the age of 13 has provided us with personal information, a parent or guardian of that child may contact us and request that such information be deleted from our records and termination of the corresponding account.

California Privacy Rights:If you are a California resident, the you may request that the Company not share you contact information with third parties for direct marketing purposes. California residents that wish to opt-out should email request to hi@shisako.com and provide us with 30 days to process your request.

 

Notice to European Union Users:This Policy and its enumerated policies are intended to comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the “General Data Protection Regulation” or “GDPR”) and provide appropriate protection and care with respect to the treatment of your personal information in accordance with the GDPR. The Company will not process your user information without a lawful basis to do so, as such bases are defined in Article 6 of the GDPR. In general, the Company will process your information on the legal bases of consent, contract (if you have entered into an agreement with us and such processing is a necessary part thereof), or legal obligation (as noted above). The Company may also process certain information on the basis of the following legitimate interests, provided that such interests are not overridden by your privacy rights and interests: developing and improving the Website and/or Services, conducting research from your behaviour on the Website (e.g., analysing traffic, and providing a stable, consistent, and secure experience in connection with the Website.

Notwithstanding the foregoing, and any other provision in this Policy, while the Company makes reasonable efforts to comply with various international regulations and legislation applicable to its Users, you acknowledge and agree that the Website and Services are provided by a Canadian company, and primarily targeted to a Canadian userbase. If you are not a Canadian resident, while your access and use of this Website at is at your own risk, the Company will make reasonable efforts to accommodate your privacy concerns and requests. SECURITY

When you submit sensitive information through the Website your information is encrypted. Computers and servers that contain personally identifiable information are kept in a secure location.

Your Personal Data may be accessed by and/or transmitted to employees to perform a task related to the Website or Services. 

CHANGES TO THIS POLICY

The Company may, in its sole discretion, make changes to this Policy at any time. If the Company makes minor changes, it will notify you by revising the date on the top of this Policy. If the Company makes a material change to this Policy, then the Company will notify you in writing or place a statement on the homepage of the Website. We suggest you review this Policy and the Terms of Use frequently.
